PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SITES AND OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IT IS THE RESPONSIBILITY OF YOU, THE USER, CUSTOMER, OR PROSPECTIVE CUSTOMER TO READ THE TERMS AND CONDITIONS BEFORE PROCEEDING TO USE THIS SITE. IF YOU DO NOT EXPRESSLY AGREE TO ALL OF THE TERMS AND CONDITIONS, THEN PLEASE DO NOT ACCESS OR USE OUR SITES OR OUR SERVICES. THIS TERMS OF SERVICE AGREEMENT IS EFFECTIVE AS OF 1/03/2023

Terms of Service Agreement

General terms and conditions for using the platform: www.addatopclean.de

The following Terms and conditions of Service Agreement is a legally binding agreement that shall govern the relationship with our users and others which may interact or interface with AddaTopClean GbR.

AddaTopClean GbR a professional service company that specializes in commercial and residential cleaning operating as AddaTopClean.

The Site is an service booking website that offers residential and commercial cleaning service which has the following description and policies:

I. Services and Booking

AddaTopClean GbR agrees to provide you with the Services and you agree to pay the quoted price for the Services on our Website, Bank transfer or in Cash at the appointment date. The request / reservation will be made on our website, you are asked to enter your personal data, description of the residence, the desired service, the desired cleaning date and time. We do not guarantee the exact dates/times selected by you on the website, the date/time selection is informative to find out when would like to schedule. Depending on availability, we will offer you the exact selected date/time or another date/time as close as possible to the initial request. Your reservation will be complete only after we analyze your request. AddaTopClean GbR will confirm your booking by e-mail and /or sms text. Our live price calculator is designate to calculate the exact cost for your cleaning, however additional costs may be added according to (paragraph III and XI).

The selection of the service and extra services must be accurate and correct. Each cleaning category of services we provide is customized differently such as: cleaning areas and/or objects, difficulty levels, execution times, products and equipment, extra services etc.

In case you selected a Recurring Cleaning Service but your house is in conditions that required you to choose the Deep Cleaning Service, a light-basic-maintenance cleaning cannot be performed. We will decide promptly if the additional time can be allocated at last minute to perform the job. If we decide that the extra time can be added and the job takes place, we reserve the right to issue an additional invoice with corresponding charges.

In the unfortunate event that we have to decline the execution of the job rescheduling/cancellation policy will apply (paragraph V). To avoid the above, you must make an accurate and correct booking from the beginning.

II. Declutter Before Cleaning

Prior to the cleaning technician’s arrival you need to remove clutter so we can effectively clean all surfaces this includes clothing, toys and dishes in the kitchen sink, etc. This will maximize productivity and ensure your home receives the best clean possible. If you prefer that our cleaning technicians remove these items, you must to select during booking ‘declutter’ as extra service.

III. Extra Services

For each service package, you can find the complete description of what is included in the service on our website. Each service has certain extra services that can be added, these are also presented on our website in the booking section. You can add additional services such as washing the dishes by hand or in the dishwasher (must be empty), decluttering, changing sheets (must be left on the bed) etc, at the time of booking. Any additional service not added or omitted at the time of booking is not included in your cleaning. In the situation where the job cannot be performed due to the omission of certain additions such as pets, declutter, extremely dirty, extra double deep scrub, etc., we will decide if the additional time can be allocated at last minute to perform the job. If we decide that the extra time can be added and the job takes place, we reserve the right to issue an additional invoice with corresponding charges. In the unfortunate event that we have to decline the execution of the job rescheduling/cancellation policy will apply (paragraph V). To avoid the above, you must make an accurate and correct booking from the beginning.

IV. Cleaning Supplies and Equipment

Our cleaners come fully equipped with cleaning products and equipment free of charge. We can bring green cleaning supplies if you requested it while booking. You can always feel free to leave any specific products for us in your household. In addition, AddaTopClean GbR requires that you have running water, electricity in order to properly perform our Services.

V. Cancellation Policy

You can cancel or reschedule for free up to 48 hours before your appointment. Cancelations communicated less than 48hrs prior to appointment are subject to be charged with 50% of the original price. If it is cancelled after the cleaners have already arrived then the appointment is subject to full charge of the original price to compensate the cleaners for holding your booking in their schedule. For same day or next day bookings you can cancel or reschedule for free within 2 hours after you make your booking.

VI. Damages and Liability

Our cleaning staff always treats your home as their own and does everything possible to be as careful as possible. In the rare event accidental damage occurs, you’ll need to notify our office within 24 hours of when the appointment is completed by email and must provide us with a detailed photo and estimate of the damages. In the first instance, we will investigate the request. After the complaint is validated as founded, we will notify you as soon as possible with our settlement decision.

The payment or replacement of small damaged items due to the exclusive fault of the cleaning staff will be made within 30 working days.

For other types of damages AddaTopClean GbR reserves the right to contract suitable professionals to investigate the request and the damage and afterwards contractors to repair damages. AddaTopClean GbR will pay the said professionals and contractors directly. The resolution time in these cases may vary between 30-90 working days or more depending on the issues.

If, following the expertise, it is proven that AddaTopClean GbR and/or cleaning technicians are not responsible for the damages, the full costs of the expertise paid to the professionals and contractors by AddaTopClean GbR will be paid by the complaining customer to AddaTopClean GbR.

Our damages/liability policy does not cover:

a) liability for pre-existing damages of any kind, scratches on any surface, dings in windows, paint, damaged furniture, damaged floors, stains absorbed in wooden or marble floors and on any kind of surface, faucets of shower cabins, bathtubs and sinks that are old, worn or unstable, unstable curtain rails, plastic or/and other materials burned on the stove, restoration of severely worn, stained or mildewed caulking and grout, etc or any items not secured in a proper manner by the customer. b) any issues that occurred after the result of the service/job has been done c) comments about our policies or policy decisions d) matters that have already been fully investigated through this complaints procedure e) dissatisfaction or complaints expressed with our policies or decisions about individual cases, funding, or requests for legal advice and assistance f) anonymous complaints d) overdue notifications

VII. Safety

We do our best to ensure a safe environment for everyone. Our cleaning staff are professionally trained. We reserve the right to remove our employees from your home should the environment be/become unsafe.

It’s a joint effort in ensuring safety. By using the Services, you agree to assist in keeping and maintaining a safe environment by:

Acknowledge and note all fragile items and let our staff and our customer service team know prior to the start of your cleaning.

Accounting for and securing all valuables prior to the start of your cleaning.

Notifying us of pets, and taking all necessary steps to unsure your pets safety and our staffs safety – Removing any biohazards

Not requiring or requesting the lifting or moving of furniture or heavy items.

For safety and liability reasons, AddaTopClean GbR will not allow its cleaning professionals to lift or move heavy items or furniture.

In the event that you don’t comply with our safety agreements we may direct our staff to leave your location (at the discretion of management), and our Cancellation Policy will apply (paragraph V).

VIII. Employee Solicitation

When using our services with AddaTopClean GbR, you agree not to solicit or hire any current employees or contractors or those previously employed by AddaTopClean GbR within the previous 24 months. If you are found in doing so, AddaTopClean GbR takes an employment referral/training fee of €3.000,-. By using our Services, you agree to notify us of any attempts to solicit or accept illegal services.

IX. Prices, terms of payment

All prices stated in offers are in euros including the statutory German sales tax.

All Payment methods are due before cleaning process.

ONLINE Payment is due 72 hours prior to the appointment date.

CASH Payment is due at the appointment date.

Exceptions are possible only for last minute requests made with less than 72 hours left until the appointment date, online payment is due upon booking confirmation or Cash at the appointment date.

We reserve the right to request online deposit payments (50% of the total cleaning cost) for move out/in appointments, deposit payment is due upon booking confirmation. The rest of the payment will be paid 72 hours prior to the appointment date or Cash at the appointment date.

Client may provide AddaTopClean GbR with a valid credit card to keep on file for billing. Client is responsible for and agrees to pay the full cost of Client’s requested services.

To pay for the cleaning services, AddaTopClean GbR offers one or more alternative payment methods such as: Credit card (VISA, Mastercard, American Express) EC/Maestro card, Bank transfer, PayPal, Cash

CEC payment method is not accepted. VAT form is not accepted.

Without exception there are no refunds for the cleaning service.

X. Wear or Tear

The longer we live in our homes, the more wear and tear builds up in it. Baseboards, bottom of showers and tubs, excessive water spots and soap scum on plastic shower doors, worn flooring, floors or doors which presents heavy marks, sticky residue, etc are all areas where wear and tear will impact results. Our results on such surfaces are generally excellent, however, sometimes may take more than one cleaning to improve in appearance.

XI. Extreme Dirtiness

We are assuming that your house/office is under normal unclean conditions. If extreme dirtiness is present and requires a more intense cleaning with a high degree of difficulty, additional fees will need to be negotiated before proceeding. We reserved the right to take pictures/videos before and after (punctually in certain areas without any personal details) and post them as advertising.

XII. Arrival time

Congested traffic, canceled or extended appointments, unforeseen situations may cause arrival delays or early arrivals. Therefore we do not guarantee the exact arrival times. In order not to depend on each other, we recommend to keep a row of property keys, if the customer agrees. All customer keys are numerically coded and locked in our office nightly. All keys are immediately returned upon cessation of service.

If you prefer to leave the key in a certain location, please mention during booking in the reserved field, the location where our technicians can find the key and also if the key must to be left in the same place or inside the house at the end of the job.

XIII. Language

Correspondence/contracts language between AddaTopClean GbR and the customer is English and/or German.

XIV. Service Complaints Policy

We strive to exceed your expectations for quality cleaning services. We inspect our work before leaving your home. Occasionally and without intention our crews may miss something.

To ensure we are able to put things rights as soon as we can, please read our complaints procedure below and we will respond promptly to ensure complete satisfaction.

You need to notify our office within 24 hours of when the appointment is completed by email and must provide us with a detailed photo/detailed description of areas of concern.

In the first instance, we will establish the seriousness of the complaint.

We guarantee to re-clean the premises that are the subject of the complaint if the complaint for these omitted areas is well-founded and precise. We will not accept/solve frivolous, absurd, petty or insignificant complaints.

After the complaint is validated as founded, we will notify you within 24 hours and the same cleaners will re-clean areas of concern within a reasonable date of the original booking. Unfortunately we do not offer refunds after a cleaning.

You can expect to be treated with courtesy, respect, and fairness at all times. We expect that you will also treat our staff dealing with your complaint with the same courtesy, respect and fairness. We will not tolerate threatening, abusive or unreasonable behavior by any complainant. Such situations are rare, however, should they happen, we will cease communication with the complainant immediately and will inform the appropriate authorities as necessary.

Our complaints policy does not cover:

a) repeated invasive complaints, in these case we reserve the right to cease the collaboration immediately. b) comments about our policies or policy decisions c) any issues that occurred after the result of the service/job has been done. d) matters that have already been fully investigated through this complaints procedure e) dissatisfaction or complaints expressed with our policies or decisions about individual cases, funding, or requests for legal advice and assistance f) anonymous complaints e) overdue notifications

XV. Discretion and Respect

Our professional technicians can focus and perform their job successfully when they are not pressured, watched, or monitored by anyone. They are trained to work without supervision, efficiently and professionally. We do not accept instructions given to our technicians on how to perform their job and/or shoulder-to-shoulder monitoring of the job. We ask you to be discreet and respectful and also to avoid the areas where the cleaning process takes place until the job is done.

XVI. Vacantions, Holidays, Weekends

If you will be out of town or on vacation please let us know as soon as possible to avoid charges. We are closed typically on Weekends and Official Public Holidays (special requests during Holidays and Weekends are subject to extra charges and available only for certain services).

XVII. Modifications

AddaTopClean GbR shall reserve the right at any time it may deem fit, to modify, alter and or discontinue, whether temporarily or permanently, our service, or any part thereof, with or without prior notice. In addition, we shall not be held liable to you or to any third party for any such alteration, modification, suspension and/or discontinuance of our Services, or any part thereof.

XVIII. Termination

Both parties, AddaTopClean GbR and Client’s have the right to terminate the Service without given reasons. If you already have a reservation, the cancellation policy (V) applies.

AddaTopClean GbR reserves the right to decline any services and/or to refuse the execution of a work to anyone at any time with or without giving reasons.

XIX. Erorrs

AddaTopClean GbR and its affiliates, co-branders, partners and any other third parties make no such warranties that website-software shall be uninterrupted or error-free.

In the event of unexpected software errors in the live price calculator or in availability or in services or in the description of the services on our website, AddaTopClean GbR reserve the right to cancel/decline/modify the reservation and/or modify the prices and/or availability, and/or services and description of the services at any time on our sole and absolute discretion.

XX. What we can not do or clean?

Outside windows/ Cleaning high to reach areas & windows/ Moving heavy furniture and appliances (max.10kg can be lifted)/ Mold Removal/ Dirt and liquids deeply absorbed on natural stones, marble, natural wood, porous surfaces/ Very high light fixture or ceiling fans/ Adhesive, Permanent marker, Paint/ Inside the fireplace/ Walls surface/ Shampoo or steam carpets / Construction plaster and residue/ Soot and smoke residue/ Deep marks from moving furniture/ Clean or vacuum curtains/ Pressure water cleaning.

XXI. Discounts, Gift Cards, Promotions

These codes can be obtained by purchasing gift cards and as well for your loyalty or by various promotions that we offer. Discount codes or gift voucher codes must be entered on the booking page in the “Coupon code” section, the entered code will not change the price in the summary booking, however, you will receive the discount after we’ll check and validate the code at the end of the booking. We will send our confirmation by email with the final cost and the discount applied.

CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

GENERAL INFORMATION

Any and all visitors to our site shall be deemed as “users” of the herein contained Services provided for the purpose of this Terms of Service Agreement.

The user acknowledges and agrees that the Services provided and made available through our website and applications, which may include some mobile applications and that those applications may be made available on various social media networking sites and numerous other platforms and downloadable programs, are the sole property of AddaTopClean GbR. At its discretion, AddaTopClean GbR may offer additional website Services and/or products, or update, modify or revise any current content and Services, and this Agreement shall apply to any and all additional Services and/or products and any and all updated, modified or revised Services unless otherwise stipulated. AddaTopClean GbR does hereby reserve the right to cancel and cease offering any of the aforementioned Services and/or products. You, as the end user acknowledge, accept and agree that AddaTopClean GbR shall not be held liable for any such updates, modifications, revisions, suspensions or discontinue of any of our Services and/or products. Your continued use of the Services provided, after such posting of any updates, changes, and/or modification shall constitute your acceptance of such updates, changes and/or modifications, and as such, frequent review of this Agreement and any and all applicable terms and policies should be made by you to ensure you are aware of all terms and policies currently in eﬀect. Should you not agree to the updated, revised or modified terms, you must stop using the provided Services.

Furthermore, the user understands, acknowledges and agrees that the Services oﬀered shall be provided “AS IS” and as such AddaTopClean GbR shall not assume any responsibility or obligation for the timeliness, missed delivery, deletion and/or any failure to store user content, communication or personalization settings.

PRIVACY POLICY

Every member’s registration data and various other personal information are strictly protected by the AddaTopClean GbR Online Privacy Policy (see the full Privacy Policy). As a member, you herein consent to the collection and use of the information provided, including the transfer of information within Germany and/or other countries for storage, processing or use by AddaTopClean GbR and/or our subsidiaries and affiliates.

COMMERCIAL REUSE OF SERVICES

The user herein agrees not to replicate, duplicate, copy, trade, sell, resell nor exploit for any commercial reason any part, use of, or access to AddaTopClean GbR sites.

MODIFICATIONS

PROPRIETARY RIGHTS

You do hereby acknowledge and agree that AddaTopClean GbR Services and any essential software that may be used in connection with our Services (“Software”) shall contain proprietary and confidential material that is protected by applicable intellectual property rights and other laws. Furthermore, you herein acknowledge and agree that any Content which may be contained in any advertisements or information presented by and through our Services or by advertisers is protected by copyrights, trademarks, patents or other proprietary rights and laws. Therefore, except for that which is expressly permitted by applicable law or as authorized by AddaTopClean GbR or such applicable licensor, you agree not to alter, modify, lease, rent, loan, sell, distribute, transmit, broadcast, publicly perform and/or created any plagiaristic works which are based on AddaTopClean GbR Services (e.g. Content or Software), in whole or part. AddaTopClean GbR herein has granted you personal, non-transferable and non-exclusive rights and/or license to make use of the object code or our Software on a single computer, as long as you do not, and shall not, allow any third party to duplicate, alter, modify, create or plagiarize work from, reverse engineer, reverse assemble or otherwise make an attempt to locate or discern any source code, sell, assign, sublicense, grant a security interest in and/or otherwise transfer any such right in the Software. Furthermore, you do herein agree not to alter or change the Software in any manner, nature or form, and as such, not to use any modified versions of the Software, including and without limitation, for the purpose of obtaining unauthorized access to our Services. Lastly, you also agree not to access or attempt to access our Services through any means other than through the interface which is provided by AddaTopClean GbR for use in accessing our Services.

WARRANTY DISCLAIMERS

YOU HEREIN EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

ADDATOPCLEAN GbR AND OUR SUBSIDIARIES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS MAKE NO SUCH WARRANTIES THAT:

(i)ADDATOPCLEAN GbR SERVICES OR SOFTWARE WILL MEET YOUR REQUIREMENTS; (ii) ADDATOPCLEAN GbR SERVICES OR SOFTWARE SHALL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THAT SUCH RESULTS WHICH MAY BE OBTAINED FROM THE USE OF THE ADDATOPCLEAN GbR SERVICES OR SOFTWARE WILL BE ACCURATE OR RELIABLE; (iv) QUALITY OF ANY INFORMATION WHICH MAY BE OBTAINED BY YOU THROUGH OUR SERVICES OR SOFTWARE WILL MEET YOUR EXPECTATIONS; AND (v) THAT ANY SUCH ERRORS CONTAINED IN THE SOFTWARE SHALL BE CORRECTED.

ANY INFORMATION OR MATERIAL DOWNLOADED OR OTHERWISE OBTAINED BY WAY OF ADDATOPCLEAN GbR SERVICES OR SOFTWARE SHALL BE ACCESSED BY YOUR SOLE DISCRETION AND SOLE RISK, AND AS SUCH YOU SHALL BE SOLELY RESPONSIBLE FOR AND HEREBY WAIVE ANY AND ALL CLAIMS AND CAUSES OF ACTION WITH RESPECT TO ANY DAMAGE TO YOUR COMPUTER AND/OR INTERNET ACCESS, DOWNLOADING AND/OR DISPLAYING, OR FOR ANY LOSS OF DATA THAT COULD RESULT FROM THE DOWNLOAD OF ANY SUCH INFORMATION OR MATERIAL. NO ADVICE AND/OR INFORMATION, DESPITE WHETHER WRITTEN OR ORAL, THAT MAY BE OBTAINED BY YOU FROM ADDATOPCLEAN GbR OR BY WAY OF OR FROM OUR SERVICES OR SOFTWARE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF SERVICES AGREEMENT.

A SMALL PERCENTAGE OF SOME USERS MAY EXPERIENCE SOME DEGREE OF EPILEPTIC SEIZURE WHEN EXPOSED TO CERTAIN LIGHT PATTERNS OR BACKGROUNDS THAT MAY BE CONTAINED ON A COMPUTER SCREEN OR WHILE USING OUR SERVICES. CERTAIN CONDITIONS MAY INDUCE A PREVIOUSLY UNKNOWN CONDITION OR UNDETECTED EPILEPTIC SYMPTOM IN USERS WHO HAVE SHOWN NO HISTORY OF ANY PRIOR SEIZURE OR EPILEPSY. SHOULD YOU, ANYONE YOU KNOW OR ANYONE IN YOUR FAMILY HAVE AN EPILEPTIC CONDITION, PLEASE CONSULT A PHYSICIAN IF YOU EXPERIENCE ANY OF THE FOLLOWING SYMPTOMS WHILE USING OUR SERVICES: DIZZINESS, ALTERED VISION, EYE OR MUSCLE TWITCHES, LOSS OF AWARENESS, DISORIENTATION, ANY INVOLUNTARY MOVEMENT, OR CONVULSIONS.

LIMITATION OF LIABILITY

YOU EXPLICITLY ACKNOWLEDGE, UNDERSTAND AND AGREE ADDATOPCLEAN GbR AND OUR SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY PUNITIVE, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES WHICH MAY BE RELATED TO THE LOSS OF ANY PROFITS, GOODWILL, USE, DATA AND/OR OTHER INTANGIBLE LOSSES, EVEN THOUGH WE MAY HAVE BEEN ADVISED OF SUCH POSSIBILITY THAT SAID DAMAGES MAY OCCUR, AND RESULT FROM:

THE USE OR INABILITY TO USE OUR SERVICE;

THE COST OF PROCURING SUBSTITUTE GOODS AND SERVICES;

UNAUTHORIZED ACCESS TO OR THE ALTERATION OF YOUR TRANSMISSIONS AND/OR DATA;

STATEMENTS OR CONDUCT OF ANY SUCH THIRD PARTY ON OUR SERVICE;

AND ANY OTHER MATTER WHICH MAY BE RELATED TO OUR SERVICES.

RELEASE

In the event you have a dispute, you agree to release ADDATOPCLEAN GbR (and its officers, directors, employees, agents, parent subsidiaries, affiliates, co-branders, partners and any other third parties) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected or unsuspected, disclosed and undisclosed, arising out of or in any way connected to such dispute.

NOTICE

AddaTopClean GbR may furnish you with notices, including those with regards to any changes to the Terms of Service Agreement, including but not limited to email, regular mail, MMS or SMS, text messaging, postings on our website Services, or other reasonable means currently known or any which may be herein after developed. Any such notices may not be received if you violate any aspects of the Terms of Service Agreement by accessing our Services in an unauthorized manner. Your acceptance of this Terms of Service Agreement constitutes your agreement that you are deemed to have received any and all notices that would have been delivered had you accessed our Services in an authorized manner.

TRADEMARK INFORMATION

You herein acknowledge, understand and agree that all of the AddaTopClean GbR trademarks, copyright, trade name, service marks, and other AddaTopClean GbR logos and any brand features, and/or product and service names are trademarks and as such, are and shall remain the property of AddaTopClean GbR. You herein agree not to display and/or use in any manner AddaTopClean GbR logo or marks without obtaining AddaTopClean GbR prior written consent.

No Warranty

WE PROVIDE THIS WEB SITE AND ITS CONTENT “AS IS” AND WITHOUT ANY REPRESENTATION OR WARRANTY, EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT REPRESENT OR WARRANT THAT THIS WEB SITE WILL BE ACCESSIBLE WITHOUT INTERRUPTION OR THAT THIS WEB SITE, ANY CONTENT FROM THIS WEB SITE, OR THE SERVER THAT MAKES THIS WEB SITE AVAILABLE ARE FREE FROM ERRORS, DEFECTS, DESIGN FLAWS, OMISSIONS, VIRUSES, OR OTHER HARMFUL COMPONENTS.
